1) Regarding the Detention Maintenance Agreement: a) Paragraph 6 needs to include the language in the prior draft indicating the County may enter onto the property and "shall have the right to seek reimbursement from the responsible Parties for its actual costs and expenses in performing the work." b) Regarding Exhibit B: if the easement is not granted over the entire property and is only over a portion of the property, then Exhibit B needs to clearly depict the portion of the property where the easement is granted. The map should visually depict the location of the easement in relation to the pond on the property. The easement must also abut a public road so the County has legal access. c) The signatory for the Metro District needs to reflect that the individual signing has authority to sign on behalf of the Metro District for Filing No. 8. The available referral documents include the Final Plat (Edward-James Surveying, Inc., October 1, 2025), Construction Documents (HR Green, April 2, 2026), and other documents. The Soils and Geology Study (Entech Engineering, Inc., October 15, 2025) was provided in the previous submittals. We offer the following additional comments: 1. Note 29 of the plat states, “Groundwater monitoring is to be conducted for one year for lots within shallow groundwater areas which are in areas in which proposed floor levels are at least three feet above maximum anticipated groundwater levels.” CGS continues to recommend that the county require groundwater monitoring/observation holes at the Flying Horse North to be checked seasonally. 2. According to the updated plat, the lots that are affected by drainages and potentially shallow groundwater include: 1, 2, 7, 8, 20, 21, 30, 33, 45, 49, and 50. CGS notes that setbacks appear to be established and noted on the plans. Building footprints should be outside the setback areas. Provided Entech’s recommendations are strictly adhered to, CGS has no further comments. Black Forest Fire Protection Districtreview 3Sep 14, 2026
Black Forest Fire Rescue has reviewed the submittal for Flying Horse North Filing No. 8. This review acknowledges the agreement reached during the previous meeting between Joe and the BFFR chiefs. The fire-protection water-supply method remains under discussion and is not approved by BFFR. The proposal to use the pressurized Sundance system, including Hydrants 17 and 21 and the existing pump-house source, requires BFFR review before it may replace the proposed cisterns. Provide documentation confirming the legal authority for BFFR and mutual-aid departments to access and use these water sources during an emergency. Identify responsibility for testing, maintenance, repairs, snow removal, vegetation control, and continuous access. Provide flow-test documentation for Hydrants 17 and 21 demonstrating a minimum uninterrupted flow of 250 gpm for two hours. The final fire-protection plan shall show approved travel routes and confirm that every parcel entrance is within two miles of an approved water source. All designated water-supply locations shall have approved all-weather apparatus access and operating areas. Hydrants shall remain visible, unobstructed, protected from vehicle damage, marked, and accessible year-round. Final connections, color coding, signs, and clearances shall meet BFFR requirements. If the system cannot meet the legal, flow, duration, distance, and access requirements, additional hydrants, cisterns, or another approved water supply may be required. Plat approval does not constitute final BFFR acceptance of the water-supply arrangement. Fire apparatus access roads shall maintain a minimum unobstructed width of 20 feet, vertical clearance of 13 feet 6 inches, an approved all-weather surface, grades not exceeding 10 percent unless specifically approved, and turning radii suitable for BFFR apparatus. A minimum unobstructed width of 26 feet shall be maintained near hydrants. Required access shall be completed before combustible construction begins. The proposed deviation for the length of Sandbagger Drive does not waive fire-code access requirements. The final road system shall provide approved emergency access, apparatus turnaround, and evacuation capability. Any gates shall have an approved Knox emergency-access system and shall not reduce the required width. BFFR may require additional access, road interconnection, or turnaround improvements. Flying Horse North Filing No. 8 is subject to the Colorado Wildfire Resiliency Code. The existing wildfire report does not replace CWRC review. Ground-truthing shall be completed and submitted to BFFR to establish the applicable hazard class. Each lot and structure shall comply with the assigned hazard-class requirements in effect when its permit is issued. All homes and accessory structures shall have an approved Class A roof covering or Class A roof assembly. Exterior walls, siding, eaves, soffits, decks, projections, doors, windows, vents, and other components shall use approved noncombustible, ignition-resistant, ember-resistant, or other CWRC-compliant materials. Vinyl siding and other combustible exterior materials are prohibited where disallowed by the assigned hazard class. Roof edges, eaves, soffits, attic vents, foundation vents, and other openings shall resist ember intrusion. Vent openings shall have approved ember-resistant protection or corrosion-resistant metal mesh with openings not exceeding 1/8 inch. Decks and similar projections shall use approved CWRC-compliant materials. Combustible storage beneath decks is prohibited, and required under-deck protection shall be provided. Combustible fencing shall not connect directly to a structure without an approved noncombustible transition. Maintain a noncombustible zone within five feet of each structure, including beneath decks and projections. Combustible mulch, firewood, stored materials, dead vegetation, and similar ignition sources are prohibited in this zone. Vegetation from 5 to 30 feet shall be spaced and maintained so it does not create a continuous fuel path to structures. Extended defensible space and natural grasses shall be maintained under the CWRC and approved wildfire mitigation plan. Vegetation along evacuation routes, apparatus roads, hydrants, pull-offs, and roadway shoulders shall be managed to reduce fire exposure and preserve access. The HOA or responsible entity shall maintain common-area defensible space, roadsides, emergency routes, hydrant areas, and other wildfire mitigation features. CWRC requirements shall be included in subdivision or recorded documents. Each building requires separate review under the CWRC, the adopted 2021 International Fire Code, and its adopted appendices. Required documentation and inspections shall be completed before final approval or occupancy. Changes to the lot layout, water supply, access, roads, wildfire mitigation plan, or proposed construction shall be resubmitted to BFFR.

Cherokee Metropolitan District does have a 24" Water line from Sundance Ranch that is in the general vicinity of the Flying Horse North development. Please see the attached image for reference. The development's water is being provided by drilling their own wells and no sanitary sewer treatment is needed from Cherokee M. District. No conflicts with Cherokee Metro District water infrastructure for this plan. No further review needed

Where will the cisterns be located and how will they be constructed? The cisterns' compliance with NFPA 1142 and NFPA 22 can not be determined with the information provided. How will the cisterns be filled? Has the storage of water for fire protection been added to the State Water Finding?

Enumerations will review the pre-plat (mylar) prior to plat for address placement, street names, and title block. b. A $10.00 per lot and tract platting fee will be due at the time of the review of the pre-plat, (two addresses per lot and tract). If an address is not needed on a tract then no fee applies. Check should be made out to PIKES PEAK REGIONAL BUILDING DEPARTMENT or PPRBD. As of December 5th 2023, the fee for all credit/debit cards has changed from the flat 2.95% fee to the following: Over the phone Credit/Debit Card payments will be 2.3% and In-Person Debit Card payments will be 1.5% (in-person only). Academy District 20 is in receipt of File # SF2531 for approval of the Flying Horse North Filing No. 8 Final Plat. The District is requesting fees in lieu of land dedication per the existing County Code for all residential units within this development. The District is experiencing ongoing residential development. The District gained approximately 13,650 new residential units between 2018 and 2025 which included 5,650 Single Family, 1,225 Single Family Attached, and 6,800 Apartments as reported to the District by local developers. During that same timeframe, the District only experienced a total membership increase of 23 students. This information is updated annually in October. A drop in the birth rate plus the significant increase in the cost of housing has slowed student growth in the District. The District is able to serve each student who is a resident of District 20.
