The available referral documents include the PUD & Preliminary Plan Major Amendment (HR Green, August 13, 2026), Letter of Intent (HR Green Development, LLC, July 27, 2026), the Response to CGS Review Comments (Entech Engineering, Inc., August 17, 2026), and other relevant documents. Entech’s responses in their August 17, 2026 letter generally address our previous comments for Filing No. 9. Specifically: 1. Entech states in their response letter, “Due to the size of the lots and overall grade variations across the lots daylighting of drains should be feasible.” An underdrain system should be allowed ONLY if it can gravity discharge to a daylight outfall or is connected to an existing underdrain system that gravity discharges to a daylight outfall. 2. As indicated by Entech in their response letter, erosional setbacks should be established near drainages and noted in the plans. Building footprints should be outside the setback areas. Entech states in their response letter, “In all of our studies shallow groundwater has not been encountered except in well-defined drainages.” The preliminary plan (Geologic Hazard Note) states, “Groundwater monitoring/observation holes to obtain groundwater data to verify that proposed floor levels are at least 3-feet above maximum anticipated groundwater levels and maintained-year round are to be implemented.” CGS continues to recommend that the county require groundwater monitoring/observation holes at the Flying Horse North to be checked seasonally. Provided Entech’s recommendations are strictly adhered to, CGS has no further comments. The El Paso County Conservation District has reviewed this and we have the following comments: 1) Erosion controls/Revegetation plans/Watershed protections We did not see any documents that went over an erosion control or revegetation/landscape plan during and post construction of the proposed building. We feel that this is particularly important for both the road and house construction phases because this sits in a drainage of E Cherry Creek that not only drains into the local golf course ponds, but also further down within about a mile is also the Franktown Parker FPE - 2 Reservoir. This is a stormwater control dam that El Paso County maintains and EPPC shares an easement on, as well is part of regular inspections of through our MOU with El Paso County. As such, EPCCD would like to see the following recommendations followed during and after construction: A) Disturbed areas not being built on should be mulched and revegetated within 45 days of disturbance using plant/grass species native and/or naturalized to El Paso County, weather depending. B) Disturbed areas be either: mulched after seeding with either weed-free hay or straw mulch at approximately 5,000 lbs per acre; Or approx. 1-2" of wood mulch coverage of these disturbed areas made from forest mitigation work and tree clearing on site; Or areas that are not suitable for revegetation such as driveways, parking areas (if not going to be paved), or safety areas around buildings should have a 1-2" thick layer of crushed rock, road base, or gravel to assist in preventing having exposed soil that would be prone to wind/runoff erosion concerns. C) Prior to any soil work, silt fences need to be installed around all work areas to ensure loose soil does not become an erosion issue for the drainage in the event of heavy rainfall events. D) For areas being replanted with natural grass, consider using the El Paso County Conservation District’s Native Shotgun Mix (available at EPCCD.org) for reseeding, which is well suited to soils present on this site and is comprised of 100% native and naturalized grass species. 2) Firewise, Fire Risk, and Forest Health EPCCD has a strong commitment to forest health and fire safety within the areas we serve, particularly within Black Forest. The project site is located in a lightly forested transition area of Black Forest that carries an elevated wildfire risk, particularly due to its close proximity to the Hwy 83 Corridor, which is very heavily overgrown. The applicant had a fantastic Forest Management plan is obviously working with a forestry expert already to manage forest health, so we have no comments to add on that topic. We did not see an Firewise plans for when house construction begins, so we would like to see the following implemented to assist with these issues: A) Vegetation management consistent with Firewise principles, including clearing trees and brush within approximately 35 feet of the proposed building. Trees should also be cleared to approximately 15 feet from the centerline on each side of all driveways, which is critical for safe emergency vehicle access and for faster emergency egress of residence in the event of a wildfire. B) Thinning forested areas within 35–100 feet beyond the proposed houses (as recommended by Firewise practices) to approximately 40–60 trees per acre, reflecting a healthy Ponderosa pine and Douglas fir forest density based on U.S. Forest Service and Colorado State Forest Service guidance. This also supports improved fire resilience, wildlife habitat, and visual quality consistent with the El Paso County Master Plan for this area. If these measures are added to the project's plan, then the El Paso County Conservation District will be content with the applicant's commitment to soil conservation, watershed protection, and protection of the surrounding community. Black Forest Fire Protection Districtreview 1Jul 14, 2026
BFFR accepts the proposed amendment based on the access and fire water supply discussions previously held with the applicant, design team, fire protection consultant, and BFFR representatives. The approval is based on the understanding that the project will be constructed and maintained in accordance with the access and water supply approach discussed and agreed upon during those meetings. From a fire apparatus access standpoint, the submittal identifies a new roadway serving the 11 lots with a cul-de-sac and a total road length of less than 1,000 feet. Fire apparatus access shall comply with the currently adopted **International Fire Code**, including **IFC Section 503**, applicable IFC appendices, El Paso County requirements, and BFFR standards. Access roads shall provide an approved all-weather surface, minimum unobstructed width, minimum vertical clearance of 13 feet 6 inches, acceptable grade, turning radius, and load-bearing capacity for BFFR apparatus, including engines, ambulances, brush apparatus, and water tenders. The proposed cul-de-sac and roadway layout are acceptable at this stage provided the final construction documents maintain fire apparatus access compliance and do not create access restrictions. For fire protection water supply, BFFR reviewed the Fire Protection Report prepared for Filing No. 9. The report identifies the existing fire hydrant at the Flying Horse North clubhouse as the primary pressurized water source for fire protection support. The report states that this hydrant is supplied by the irrigation pump system located west of the clubhouse and is capable of providing a minimum of **500 gpm at 20 psi**. The report also states that the pump house contains three 750 gpm pumps, with total available pump capacity up to 2,250 gpm. The clubhouse hydrant is identified as being approximately one-half mile from the furthest lot within Filing No. 9. This water supply approach is consistent with the discussions and agreements reached with BFFR and is accepted provided the hydrant, pump system, and access remain available, maintained, and operational for fire department use. The Fire Protection Report identifies two required access improvements related to the fire water supply. First, approved Knox access shall be provided at the clubhouse and pump house gates so BFFR and mutual aid companies can access the hydrant and pump house during an emergency. Second, the parking space closest to the clubhouse hydrant shall be marked as a fire lane to maintain unobstructed access to the hydrant. BFFR agrees with these requirements. These items shall be completed and maintained prior to final fire acceptance or as otherwise approved by the BFFR AHJ. The project is located within the Black Forest wildland-urban interface area. The submitted wildfire report classifies the Filing No. 9 area as a low fire intensity classification based on current fuels, topography, surrounding golf course fuel breaks, and proposed mitigation. All future homes, accessory structures, and site improvements shall comply with the adopted Colorado Wildland Urban Interface / Wildfire Resiliency Code, adopted building code, adopted International Fire Code, and BFFR requirements in effect at the time of building permit. Defensible space, vegetation management, ignition-resistant construction, and driveway access shall be maintained for the life of the development. Black Forest Fire Rescue recommends **acceptance with conditions**. Acceptance is contingent upon maintaining the agreed-upon fire apparatus access, maintaining the clubhouse hydrant and pump house water supply for fire department use, installing approved Knox access at required gates, marking and maintaining the hydrant access area as a fire lane, and complying with all applicable IFC, WUI, addressing, driveway, and BFFR requirements. Any material change to the proposed access layout or fire water supply method shall be resubmitted to BFFR for review and approval.
